Agreement

By creating a BuilderNow account or using our services, you agree to these Terms of Service. If you don’t agree, please don’t use the service. BuilderNow.net is operated by SavePro Designs, based in Yuba City, California, USA.

The service

BuilderNow provides a web-based website builder, hosting, and related services for small businesses. We handle design, hosting, SSL, and domain management; you provide content and manage your account.

Free trial

New customers can try BuilderNow free for 30 days. The trial gives you the full builder and a complete, working site on a yoursite.buildernow.net subdomain, with SSL included. No credit card is required to start, and you are under no obligation to continue.

A trial site runs on a BuilderNow subdomain. Registering a custom domain of your own is part of the paid plan, not the trial.

When the 30 days end, you can upgrade to a paid plan to keep your site online. If you don’t, the site is deactivated and the subdomain stops serving it. Nothing is charged automatically at the end of a trial — a paid plan only starts when you choose one and enter payment details.

Your work is not thrown away when a trial ends. Your account content is kept as described under If you cancel or your trial ends below, so if you come back later we can usually put your site back the way you left it.

One trial per business. We may decline or end a trial where someone is opening repeat trials for the same business to avoid paying, or otherwise using trials in a way this agreement doesn’t allow.

Your account

You’re responsible for:

• Keeping your login credentials secure
• All activity that occurs under your account
• Providing accurate business and billing information
• Notifying us of any unauthorized account access

Your content

You retain ownership of all content you provide to BuilderNow — your business information, the text on your pages, and any photos or logos you upload. By providing it, you grant us a license to host, display, and serve that content as part of providing the service to you.

You are responsible for ensuring you have the rights to any content you upload. You agree not to upload content that is illegal, infringing, abusive, deceptive, or violates the rights of others.

The website itself — the templates, layouts, code, styling, and any stock imagery we supply — remains ours. Your subscription is a license to use it while your plan is active. It is not a sale or transfer of the site, and we do not provide site files, source code, or templates for use elsewhere. Your content stays yours; the site that displays it does not transfer with it.

Acceptable use

You agree not to use BuilderNow to:

• Engage in any illegal activity
• Publish, host, or distribute pornography, sexually explicit or obscene material, or advertise adult or escort services
• Publish or distribute content that is excessively violent, or that harasses, threatens, or promotes hatred or violence against any person or group
• Distribute malware, phishing, or other malicious content
• Send spam or unauthorized bulk communications
• Impersonate others or misrepresent your identity
• Attempt to disrupt, compromise, or probe our systems
• Violate intellectual property, privacy, or other rights of others

We reserve the right to suspend or terminate accounts that violate these rules. Sites hosting sexually explicit material are terminated immediately, without notice and without refund.

Content that sexually exploits a minor is reported to the National Center for Missing & Exploited Children and to law enforcement, and the account is terminated permanently.

Payment and billing

Paid plans are billed in advance on a monthly or yearly basis. Payment is processed securely through Square. By providing payment information, you authorize us to charge your selected payment method for the applicable fees.

All fees are non-refundable, including unused portions of your subscription. You may cancel at any time, and your access will continue through the end of your current billing period.

Domain names

If we register a domain on your behalf, it is registered in your name. You own the domain. If you cancel your BuilderNow account, we will transfer the domain to your new host or registrar at no additional charge.

If you cancel or your trial ends

You may cancel your account at any time from your dashboard or by contacting support. We may suspend or terminate accounts that violate these terms, fail to pay, or present security risks.

When a paid plan is cancelled, your site stays online until the end of the billing period you have already paid for, then it is deactivated. When a free trial ends without being upgraded, the trial site is deactivated at that point. If we registered a domain on your behalf, we transfer it to you or to your next host at no charge.

We keep your account content on file after deactivation rather than deleting it, so that if you return later we can usually restore your site as it was. Photos and logos you uploaded are the exception: image files may be cleared from our servers after roughly a year of inactivity, so keep your own copies of anything you would not want to re-upload.

Deactivation removes the site from the web. It does not hand over the site itself — as set out under Your content, the templates, code, and design stay ours, and we don’t supply site files or source code. Your own text, business information, photos, and logos are yours, and we will provide a copy of them on request.

Service availability

We work hard to keep BuilderNow running smoothly, but we don’t guarantee uninterrupted service. Planned maintenance is communicated in advance. We’re not liable for downtime caused by circumstances outside our control (internet outages, third-party service disruptions, etc.).

Warranties and liability

BuilderNow is provided “as is” without warranties of any kind, express or implied. To the fullest extent permitted by law, our liability to you is limited to the amount you’ve paid us in the 12 months preceding any claim.

Changes to these terms

We may update these terms from time to time. When we do, we’ll update the “last updated” date and, for material changes, notify account holders by email. Continued use of the service after changes take effect constitutes acceptance of the new terms.

Governing law

These terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Sutter County, California.
